The terms that apply when you use this website, and what our online content does and does not promise.

These Terms of Use (the "Terms") govern your use of www.agenergyco.com (the "Site"), which is operated by Ag Energy Company, LLC ("Ag Energy," "we," "us" or "our"). Please read them before using the Site.

1. Acceptance of These Terms

By visiting or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Informational Purposes; No Professional Advice

The Site describes our services and provides general information about solar energy, battery storage, EV charging, financing options and energy incentives. That information is provided for general educational purposes only. Nothing on the Site is tax, legal, accounting, engineering or financial advice, and none of it takes your particular situation into account. Before making decisions about a solar or energy project, consult your own tax advisor, attorney, accountant, lender and, where appropriate, a licensed engineer.

3. Estimates and Projections

Any figures on the Site relating to energy production, cost, savings, payback period, return on investment, cash flow or system lifetime are examples or estimates, not guarantees. Actual results vary from site to site and depend on factors including system size and design, roof or ground conditions, shading, weather and sunlight, equipment selected, utility rates and tariff structures, net-metering and interconnection rules, your energy usage, and your eligibility for incentives. Past company growth and prior project outcomes do not predict future results. Figures specific to your project will be provided only in a written proposal prepared for you.

Do not rely on figures shown on the Site to make a purchase, financing or tax decision. Rely only on the written proposal we prepare for you and on advice from your own professional advisors.

4. Incentives and Tax Credits

Federal, state, utility and local incentive programs, including the federal Investment Tax Credit, change over time. Whether you qualify, the percentage or amount available, and when a benefit is realized depend on the law in effect when your system is placed in service and on your own tax and business situation. Percentages and dollar amounts shown on the Site reflect our understanding at the time the page was written and may be out of date. Ag Energy does not provide tax advice and does not guarantee that you will qualify for or receive any incentive. Confirm eligibility and amounts with a qualified tax advisor before relying on them.

Incentive programs can be reduced, phased out or ended by Congress, the U.S. Treasury, the IRS, state legislatures, regulators or utilities, sometimes with little notice and sometimes with deadlines tied to when construction begins or when a system is placed in service, or with conditions on where equipment is sourced. Ag Energy has no obligation to update the Site when a program changes, and is not responsible for any incentive you do not receive because of a change in law or program rules, a missed deadline, an equipment-sourcing requirement, or your own tax position.

5. Equipment and Workmanship Warranties

References on the Site to warranties, including any warranty length stated on the Site (such as "up to 25 years" or "10–25 years"), are general descriptions only. Warranties on panels, inverters, batteries and other equipment are provided by the equipment manufacturer under the manufacturer's own written terms, which may include conditions, exclusions and registration requirements. Any workmanship warranty from Ag Energy is defined solely by your signed installation agreement. Nothing on the Site creates, extends or modifies any warranty, and the Site is not a warranty document.

6. No Offer or Contract

Nothing on the Site is an offer to sell, a quote, or a binding commitment by Ag Energy. Services, prices, timelines, equipment and financing options described on the Site are subject to change and availability. Any agreement between you and Ag Energy will be set out in a separate written proposal and signed contract, and those documents control over anything on the Site. A free site assessment is a preliminary evaluation and does not obligate you or Ag Energy to proceed with a project. Financing described on the Site is offered by third-party lenders and is subject to their credit approval and terms; Ag Energy is not a lender.

7. Intellectual Property

The Site and its content, including text, photographs, graphics, logos, the "AG ENERGY" wordmark and the Site's design, are owned by Ag Energy, licensed to us, or in the public domain, and are protected by copyright, trademark and other laws where applicable. You may view, download and print pages from the Site for your own personal or internal business use in evaluating our services. You may not copy, republish, distribute, modify or use the content for commercial purposes without our prior written permission.

8. Acceptable Use

You agree not to misuse the Site. In particular, you agree not to submit false or misleading information through the contact form, send unsolicited commercial messages through it, use automated tools to submit forms or scrape the Site, attempt to access staff-only areas, or interfere with the Site's operation or security.

9. Contact Form and Communications

When you submit the contact form, call us or email us, you agree that Ag Energy may contact you by phone, email or text message about your inquiry and any resulting project, using the details you provide. Agreeing to be contacted is not a condition of purchase, message and data rates may apply to text messages, and you can ask us to stop contacting you at any time. Information you submit through the Site is not confidential and is not protected by any professional privilege. Do not send sensitive information such as Social Security numbers, financial account numbers or passwords through the Site.

10. Third-Party Links

The Site contains links to our pages on Facebook, LinkedIn, Instagram, TikTok and YouTube, and may link to other outside websites. Those sites are not operated by Ag Energy. We provide the links for convenience only and do not endorse, control or take responsibility for their content, products or privacy practices.

11. Disclaimer of Website Warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, Ag Energy disclaims all warranties regarding the Site, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Site's content is complete, accurate or current. This section is about the Site itself; it does not affect any warranty contained in a signed installation agreement.

12. Limitation of Liability

To the fullest extent permitted by law, Ag Energy and its members, managers, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, revenue, data or business opportunity, arising out of or relating to your use of, or inability to use, the Site or your reliance on its content, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you. This section does not limit any liability that cannot be limited under Illinois law, and it does not apply to obligations under a signed installation agreement, which has its own terms.

13. Indemnification

You agree to defend, indemnify and hold harmless Ag Energy and its members, managers, employees and agents from any claim, loss, liability or expense, including reasonable attorneys' fees, arising out of your misuse of the Site, your violation of these Terms, or information you submit through the Site that is false, misleading or infringes another person's rights.

14. Governing Law

These Terms and any dispute relating to the Site are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any legal action relating to the Site will be brought in the state courts located in Kankakee County, Illinois, or in the United States District Court for the Northern District of Illinois, and you consent to the jurisdiction of those courts.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and Ag Energy about your use of the Site; they do not replace or modify any signed proposal or installation agreement. Section headings are for convenience only.

16. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Site after a change means you accept the revised Terms.
